General Terms and Conditions (GTC) of Niloo GmbH

1. Object of the Platform

Niloo GmbH operates a digital platform for connecting customers, taxi companies, drivers, and other mobility service providers.

The platform serves in particular:

• digital communication between customers and mobility providers,
• the management and dispatching of booking requests,
• the provision of technical infrastructure,
• the organization and execution of mobility services.

Niloo can assume different roles in this process:

a) Provision of a technical platform for affiliated taxi companies and mobility providers
or
b) Dispatching of rides between customers and suitable transport companies or drivers.

The respective role is transparently displayed to the user within the app or during the booking process.

2. Role of Niloo

Niloo is a digital mobility platform.

Depending on the function offered, Niloo may:

• provide technical infrastructure,
• dispatch bookings between customers and taxi companies,
• offer communication services,
• enable digital payment and administrative functions.

If Niloo acts exclusively as a technical platform, the transport service is provided solely by the respective taxi company.

If Niloo dispatches a ride or acts as the provider of a dispatch service, the corresponding booking conditions within the app apply.

3. Carriage Contract

The transport contract is concluded depending on the model:

Model A – Taxi Company as the Service Provider

The contract for the ride is concluded between the customer and the taxi company.

• drivers,
• vehicles,
• execution of the ride,
• pricing,
• invoicing,
• compliance with legal regulations.

Model B – Dispatch via Niloo

For rides dispatched via Niloo, Niloo supports the booking process and dispatches suitable drivers or companies.

The specific information regarding the ride, price, and contractual partner is displayed to the customer before the booking is completed.

4. Prices

Prices may be determined depending on the respective offer by:

• taxi companies,
• mobility providers,
• or Niloo, if Niloo provides its own dispatch models or offers.

The price displayed in each case is part of the booking process.

5. Registration and User Account

Users must provide correct information when creating an account.

Niloo can block or restrict accounts if:

• incorrect information is provided,
• the platform is misused,
• legal regulations are violated.

6. Cancellations and No-Shows

Regulations regarding:

• cancellations,
• waiting times,
• fees,
• refunds

may apply depending on the respective provider or dispatch model and will be displayed before the booking is completed.

7. Drivers and Partner Companies

Partner companies and drivers are obliged to:

• comply with legal requirements,
• possess valid permits,
• provide safe vehicles,
• offer professional services.

8. Liability

Niloo is not liable for services provided exclusively by independent taxi companies or drivers.

This applies in particular to:

• execution of a ride,
• conduct of a driver,
• vehicle condition,
• delays,
• quality of transport.

To the extent that Niloo provides its own dispatch or platform services, Niloo is liable in accordance with legal regulations.

9. Extension of the Offer

Niloo ist berechtigt, weitere Mobilitätsangebote, Vermittlungsmodelle oder Dienstleistungen anzubieten und die Plattform entsprechend weiterzuentwickeln.

10. Data Protection

The processing of personal data is carried out in accordance with Niloo's privacy policy.
